This Privacy Policy explains how we at Migoo (together with our affiliates, “Migoo”, “we”, “us”) collect, use, retain, disclose, and process personal data (defined below) in connection with the websites, applications, and services that link to this policy (the “Services”).

1.2 "Personal Data" or "personal data" means data that identifies, relates to, describes, is reasonably capable of being associated with or could, with the other information available, reasonably be linked, directly or indirectly, with a particular individual or household.

1.3 We may also choose or be required by law to provide different or additional disclosures relating to the processing of personal data about residents of certain jurisdictions. Capitalized terms used in this Privacy Policy have the meanings given to them in the Terms of Service, unless otherwise defined.

1.4 We may modify this Privacy Policy from time to time, in which case we will update the last updated date of this Privacy Policy, posting the new Privacy Policy, or providing any other notice required by applicable law. We recommend that you review this Privacy Policy regularly to stay informed of our privacy practices.

2. How We Collect Information About You

2.1 We may collect certain categories of information about you and from a variety of sources. For example, we collect information about you when you interact with us or use or access the Services. The categories of personal data we collect depend on how you interact with us and our Services.

2.2 For example, you may provide us your personal data or other information when you:

• visit, use, or interact with the Services;

• register and/or use the Services or open an account with us (“Account”);

• provide input to the Services, including through prompts, chats, and other content that you upload or submit;

• communicate with us, such as via email, surveys, forms, or through our webpage, app, or social media sites;

• when you link or connect your Account with third-party accounts, applications, platforms, or services, including those that integrate with the Services (“Connected Services”);

• when you grant permissions that authorize us to obtain personal from or via the Connected Services, including your email, calendar, social media, or other accounts or access;

• when you instruct the Services to access, navigate, log into, or interact with third-party websites or applications on your behalf, including through any embedded or hosted browser features;

• when you purchase or use Points or other paid features, including when you provide payment information, billing address, or other information needed to complete a transaction;

• when you grant permissions on your device to share information with us, including if you choose to share your device contacts, photographs, calendar, location, microphone, camera, or other access.

2.3 We may also collect personal data automatically from other sources and third parties. For example, we may obtain information about you from other third parties, including analytics providers, or from business partners and other companies that we partner with to provide you with access to the Services, including based on information you provide to us.

2.4 Any information you provide, including via the Connected Services, or that we receive from third-party sources will be treated in accordance with this Privacy Policy. We are not responsible for the accuracy of the information provided to us by you or any third parties, and we are not responsible for any third party’s policies or practices.

3. Information You Provide to Us

3.1 Some features of the Services may request or require information about you. You may elect not to provide this information, but doing so may prevent you from using or accessing these features. Information that you directly submit includes:

• Identifiers and Other Account Information. We may collect identifiers such as name, phone number, email address, mailing address, and user ID, as well as other information associated with your account like your communication preferences. We use this information for purposes including to fulfill our contract with you, provide you with the Services, administer your Account, complete your requests or transactions, communicate with you, and send you marketing communications (in accordance with your preferences). If you invite others to use the Services, we will collect their email address from you to send the invitation.

• User Content. You can input, upload, make accessible, and submit information, instructions, and other materials into Migoo ("Input"). This includes any files, documents, audio, videos, images, data, calendar information, contact information, messages and other communications, you provide or make accessible to us, either directly or through any third-party applications or Connected Services you choose to integrate with the Services. Where you enable or use any browser-based features, your Input may also include the content of web pages or applications you direct the Services to access, information you ask the Services to extract or summarize, and information you instruct us to enter into forms or interfaces on third-party sites on your behalf. Based on your Input, Migoo will use various AI tools and functionalities, including third-party providers and applications, to generate text, images, video, and other responses (“Output”) or to carry out actions on your behalf, including through the Connected Services or on websites or applications accessed through the Services (“Actions”). We use this information to provide the Services to you, to learn about you and your preferences, and to improve and personalize the Input, Output, and Actions we can provide to you and undertake on your behalf. The information that you make accessible to us, including via the Connected Services, may inform and modify the Input used in providing the Services to you and, accordingly, may also be reproduced in the Output or reflected in the Actions provided.

• Browser Data. When you enable or use browser-based features in Migoo, you authorize Migoo to interact with web pages and apps in your local browser environment. This includes: (i) page content that Migoo reads, extracts, and processes from web pages or apps you authorize, including content from premium or authenticated services you are logged into; (ii) browser actions such as clicking, scrolling, form filling, and navigation performed on your behalf; and (iii) session context leveraging your existing browser sessions and login states. Data collected through such browser-based uses is transmitted to Migoo servers for task processing. We do not store your login or payment credentials.

• Payment and Transaction Information. If you purchase Points or other paid features, we may collect information about the transaction, such as payment method type, payment instrument details, transaction identifiers, billing address, and the amount and timing of the transaction. We use this information to process your payments, provide the purchased Services, detect and prevent fraud, manage chargebacks or disputes, and comply with legal and tax obligations.

• Feedback and Support Information. We appreciate your feedback. We may collect information contained in your feedback, including the contents of messages sent through forms, chat, email, social media, or other channels available to customers. We use this information primarily to investigate and respond to your inquiries, to communicate with you, and to improve the Services.

4. Information Collected Automatically

4.1 We and certain third parties may automatically collect information about how you access, use, and interact with the Services, including:

• Internet or Other Electronic Activity Information. This may include your device type, manufacturer, and model, operating system, IP address, browser type, Internet service provider, and unique identifiers associated with you, your device, or your network (including, for example, a persistent device identifier or advertising ID, where applicable). This may also include information about your use of and interactions with the Services, including information about the browsers or applications you use to access the Services and the actions you take on the Services, including click, scroll, and keystroke data, time stamps, impressions, and log data. Where you use browser-based features, this may also include technical and usage information about the websites and web applications you direct the Services to access (such as URLs, timestamps, interaction logs, and high-level navigation events), which we use to operate, secure, and improve those features.

• Log and Troubleshooting Information. We may collect information about how the Services perform when you use them. For example, if your device experiences an error, we may collect information about the error, the time the error occurred, the feature being used, the state of the application, and communications or content provided at the time the error occurred.

• Information About Your Location. This could include your precise location or the approximate location that we or our third-party providers may derive from your IP address. If you make map or location data accessible to us, we may collect other information about your location and location history.

4.2 This information may be collected through the use of our own and our third-party partners' automatic data collection technologies, including through the use of cookies, pixels, scripts, and other small data files (collectively, “cookies”) that may be stored on an individual's computer or device. Information we collect automatically about you may be combined with other personal data we collect directly from you or receive from other sources. For more information on cookie-related choices that may be available to you, see the Your Rights and Choices section below.

4.3 Information collected through these tools allows us to recognize you, tailor features and content to you, and improve your user experience. For example, we may use this information to enhance and personalize your user experience, to monitor and improve the Services, to offer communications features such as live and automated chat, and to improve the effectiveness of our products, services, offers, advertising, communications and customer service. We may also use this information to remember information so that you will not have to re-enter it during your visit or the next time you visit the site; provide custom, personalized content and information, including targeted content and advertising (with your consent); identify you across multiple devices or sessions; provide and monitor the effectiveness of the Services; monitor aggregate metrics such as total number of visitors, traffic, usage, and demographic patterns on our website; diagnose or fix technology problems; and otherwise to plan for and enhance the Services.

4.4 Please note that blocking automatic data collection technologies through third-party tools and features may negatively impact your experience using our services, as some features and offerings may not work properly or at all. Depending on the third-party tool or feature you use, you may not be able to block all automatic data collection technologies or you may need to update your preferences on multiple services, devices or browsers. We do not have any control over these third-party tools and features and are not responsible if they do not function as intended.

5. Information Collected from Other Sources

5.1 We may obtain information about you that you choose to share with us from third parties and, in some cases, directly from third parties. In addition to information that you provide to us through the Connected Services, this includes:

• Single sign-on information. We provide you the ability to log in to the Services through certain third-party accounts you maintain, such as Apple or Google. When you use these features to access the Services, we do not receive your login credentials for the relevant third-party service. Instead, we receive tokens to identify you in our system and confirm that you successfully authenticated through the single sign-on protocol. This information allows us to more easily provide you access to the Services.

• Social media information. When you interact with the Services through social media platforms, such as when you follow us or connect your social media account with the Services, we may receive some information that you permit the social media platform to share with third parties. The data we receive is dependent upon your privacy settings with the social media platform, and may include your profile information, profile picture, username, and any other information you permit the social network to share with third parties. You should review and, if necessary, adjust your privacy settings on third-party websites and social media platforms before sharing information or linking them to the Services. We use this information primarily to operate, maintain, and provide to you the features and functionality of the Services, as well as to communicate directly with you, such as to send you messages about features that may be of interest to you.

• Partner information. This includes information we receive from other businesses and companies we partner with, which we use in our legitimate interests to provide you with access to the Services.

• Public information. We may also collect personal data and information from publicly accessible sources, such as information that’s publicly available online (like articles, websites, and journals) or from other public sources, which we use to better understand you and your preferences.

6. How We Use Personal Data

6.1 In addition to the purposes already described above, we may use personal data we collect:

• to fulfill or meet the reason the information was provided, such as to fulfill our contractual obligations and provide you with the Services;

• to create and maintain Accounts for our users, including by verifying your identity and entitlement to the Services;

• to process your Input, provide Output, or undertake Actions on your behalf;

• to create your user profile and infer information about you, such as your interests and preferences;

• to communicate with you, including via email, text message, chat, social media and/or telephone calls;

• to request and respond to feedback or complaints relating to the Services;

• to administer, improve, and personalize the Services, including by developing an understanding of your interests and preferences to deliver better Services, recognizing you and remembering your information when you return to the Services, and scanning, analyzing, and reviewing user content, messages, interactions, and associated metadata using our own and others’ technologies;

• to operate, monitor, and improve any browser-based features of the Services, including by logging and analyzing website interactions, navigation events, and task results to enhance reliability, safety, and accuracy;

• to train and improve our or our business partners’ models, subject to applicable law;

• to process and record purchases and use of Points and other paid features, including to manage your Points balance, prevent and detect fraud or abuse, handle refunds, chargebacks, or disputes, and comply with our accounting, tax, and other legal obligations;

• to conduct research and identify and analyze the Services and how you use and interact with the Services;

• to create aggregated or de-identified information that cannot reasonably be used to identify you, which we may use for the purposes described here, such as to analyze the way the Services are being used, to improve and add features to them, and to conduct research;

• to detect, prevent, investigate, or provide notice of any illegal, deceptive, or malicious activity, fraud, security breach, or other misuses of the Services or systems and to protect the security and safety of us, our users, our systems and Services, and other third parties, including by monitoring any Input, Output, or Actions;

• to defend, protect, or enforce our rights or applicable contracts and agreements (including our Terms of Service), as well as to resolve disputes, to carry out our obligations and enforce our rights, and to protect our business interests and the interests and rights of third parties;

• to comply with contractual and legal obligations and requirements and to protect the rights, privacy, safety, or property of us, our users, and third parties; and

• to fulfill any other purpose for which you have otherwise consented or for which we have a legitimate basis.

6.2 To the extent the laws in your jurisdiction do not recognize the legal basis of legitimate interest or another legal basis specified herein for a particular purpose, you consent to the collection, storage, and processing of your personal information for that purpose through using the Services.

7. Disclosure of Your Information

7.1 We may disclose your information to other parties subject to this Privacy Policy, including the following:

• Authorized third-party vendors and service providers. We may share your information with vendors, contractors, or other service providers who help us provide the Services, including for system administration, cloud storage, generative AI and content creation, security, facilitating use of browser-based activities and features, customer transaction facilitation and relationship management, marketing communications, web analytics, payment networks, and payment processing. Your inputs and information may also be routed to AI models or providers such as OpenAI, Anthropic, Google, to our agentic browser service provider, and to other selected providers, who process data under their own respective terms and privacy policies. Subject to applicable law, authorized third-party vendors may also include our advertising partners, who we may work with in connection with certain services to deliver advertising, as well as to provide advertising-related services such as reporting, attribution, analytics, and market research.

• Affiliated companies. We may disclose your information to our subsidiaries, parents, affiliates, and related corporations.

• Other Third Parties, including the Connected Services. We may disclose your information to other third parties, such as when you request or direct us to, including by linking or integrating your Account with other accounts you hold at the Connected Services, social media platforms, or other third parties. This would include the situation where you instruct the Services to take Actions on your behalf through or using the Connected Services, such as sending an email or editing a calendar entry on your behalf, or by using login integrations to make Output or other information visible to other individuals, including other users of Migoo. Where you use browser-based features or direct the Services to take actions on websites or applications, we will disclose to those third parties the information, form entries, and content necessary to carry out your instructions, such as search queries, form fields, and other website interactions. We do this as necessary for the performance of a contract, in our legitimate interest to provide you with access to the Services and integrations with third parties, or with your consent.

• Professional advisors. As necessary, we will share your personal information with professional advisors such as auditors, law firms, or accounting firms.

• In connection with a business transaction or reorganization. We or our affiliates companies may take part in or be involved with a business transaction or reorganization, such as a merger, acquisition, joint venture, or financing or sale of company assets. We may disclose, transfer, or assign personal data to a third party during negotiation of, in connection with, or as an asset in such a business transaction or reorganization. Also, in the unlikely event of our bankruptcy, receivership, or insolvency, your personal data may be disclosed, transferred, or assigned to third parties in connection with the proceedings or disposition of our assets.

• To protect our and our users’ rights or in response to our legal obligations. We may also disclose your information if we, in our sole discretion, believe it is reasonably necessary (i) to comply with applicable law, (ii) to cooperate or comply with law enforcement, judicial orders, or regulatory inquiries, (iii) to enforce our Terms or policies, (iv) to respond to threatened or actual claims asserted against us or claims that conduct or actions relating to your use of the Services have violated the rights of third parties, and (v) to ensure the safety and security of our business, employees, users, other individuals, and the public. We do this in our legitimate interest to protect our Service and business and to comply with applicable law.

• With your consent. We may share information for any other purposes pursuant to your consent or at your direction.

Our websites and other services may include links to or redirect you to third-party websites, plug-ins, applications, or other services. Third-party websites and other services may also reference or link to our websites and services. This Privacy Policy does not apply to any personal data practices of these third-party websites, plug-ins, applications, or other services. 8. Data Transfers

8.1 When you access our website or Services, you understand and agree that your personal data may be transferred to or stored outside your jurisdiction where you reside, where our servers, affiliates, or third party service providers are located. This may be a direct provision of your personal data to us, or a transfer that we or a third party make. We take measures to ensure that any parties to whom data is transferred process and store data in accordance with applicable law and the standards set forth in this Privacy Policy, and we only transfer data pursuant to legally valid transfer mechanisms.

9. Data Security and Retention

9.1 We have implemented commercially reasonable technical, administrative, physical, and organizational safeguards that are designed to protect your personal data. In addition, we take steps designed to ensure any third party with whom we share personal data provides a similar level of protection. However, despite these controls, no security measures are impenetrable, and we cannot completely ensure or warrant the security of your personal data. You should take special care in deciding what information you provide to the Services and what channels you use to transmit such information.

9.2 We may process personal data in an aggregated or de-identified form to analyze the effectiveness of the Services, conduct research, study user behavior and usage data, implement and improve our trust and safety classifications, and improve the Services as permitted under applicable laws.

9.3 We retain your personal data for as long as reasonably necessary to fulfill the purposes for which it was collected, including to satisfy any legal, accounting, or reporting requirements outlined in this Privacy Policy. We may also retain logs of Points-related transactions for a period we determine is reasonably necessary for security, fraud prevention, dispute resolution, and compliance with our legal obligations. The retention period may vary according to certain criteria, such as the context of the processing and our legal obligations, including whether we need the information to continue to provide you the Services, resolve a dispute, enforce our contractual agreements, prevent harm, promote safety, security and integrity, or protect ourselves, including our rights, property or products.

10. Children

10.1 The Services are not directed to or intended for children under the age of 18. We do not knowingly collect personal data from anyone under the age of 18, nor is any part of the Services directed to them. As a parent or legal guardian, please do not allow such children under your care to submit personal data to the Services. Please consult our Terms of Service for more information.

10.2 If you believe that a child under the age of 18 in your care disclosed personal data to us, please contact our data protection officer at dpo@migoo.ai. We will investigate any notification and, if appropriate, delete any Account used exclusively by such children and/or delete any personal data submitted as required by applicable law.

11. Your Rights and Choices

11.1 Your privacy is important to us and we strive to prioritize the protection of your personal data and compliance with all applicable privacy laws.

11.2 Depending on the laws in your jurisdiction or place of residence, you may enjoy certain rights regarding your personal data, as described further below. However, please be aware that these rights are limited, and we may also decline certain requests if we have a legal basis for doing so.

11.3 Below are rights which you may have, subject to the laws in your jurisdiction or place of residence:

• The right to know certain information about our processing of your Personal Data, including the right to access your Personal Data, often in a portable format;

• The right to request deletion of your Personal Data;

• The right to update and correct your Personal Data;

• The right to withdraw your consent with respect to certain processing or certain categories of Personal Data; and

• The right to be free from retaliation relating to the exercise of any of your privacy rights.

11.4 We don’t “sell” Personal Data or “share” Personal Data for cross-contextual behavioral advertising, and we do not process Personal Data for “targeted advertising” purposes (as those terms are defined under state privacy laws). If we engage in such activities in the future, we will provide any required notices, disclosures, and opt‑out rights (including ‘Do Not Sell or Share My Personal Information’ and targeted advertising opt‑outs) as mandated by applicable law before doing so.

11.5 Depending on your jurisdiction, you may be able to choose or limit which cookies are used when you use our Services or control the way in which your devices permit the use of cookies, such as through your browser or device settings. Note that blocking or deleting cookies may cause some of the Services, including certain features and general functionality, to work incorrectly; for example, doing so may mean we may not be able to recognize you across sessions or devices or remember some of your preferences. You may also opt out of tracking by Google Analytics here. Some mobile and web browsers transmit "do-not-track" signals. Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted, or whether they even are aware of them. We currently do not take action in response to these signals.

11.6 While we may process information about you that may be considered sensitive, we only process such information in accordance with applicable law, such as to provide the product or service you request from us, or consistent with your consent. The Services are not intended for any purpose that may be considered “high risk” under applicable laws or for making credit, educational, employment, housing, insurance, legal, medical, tax, or other important decisions about users or other persons. We also do not share your information with third parties for their own direct marketing purposes, nor do we engage in profiling which results in legal or similarly significant effects, as defined under applicable law.

11.7 To exercise your rights, you or an authorized agent may contact our Data Protection Officer at the contact information set forth below. We will process such requests in accordance with applicable laws, but please note that we may not be able to modify or delete your personal data in all circumstances. To protect your privacy, we may need to take steps to verify your identity before fulfilling your request. We will not discriminate against you for the exercise of your privacy rights.

11.8 Depending on where you reside, you may have the right to appeal a decision we make relating to requests to exercise your rights, which you can do by contacting our Data Protection Officer. If you think we have infringed data protection laws, you can file a claim with the data protection supervisory authority, generally in the jurisdiction in which you reside or where you think we have infringed data protection laws.

11.9 Beyond the rights described above, we also provide you with a number of controls over your Personal Data and how it is used. You can always change these settings in your account. These include the following controls:

• you may delete your Account or remove our application from your device.

• you can unsubscribe from marketing communications you receive from us by using the choices provided in those communications.

• you can remove or limit permissions, access, and linked third-party accounts that you have given us access to, either through the Services or in some cases on the third party’s website or application.

• For example, you can review and revoke permissions granted to the Services at any time through your Google Account security settings here: https://myaccount.google.com/security. Revoking permissions may limit or disable the availability or functionality of the Services.

• Similarly, many mobile devices allow you to change your permissions to prevent the Services from accessing certain information from your device (such as your contact lists, photos, or geolocation data).

• Many social media platforms allow you to change your platform permissions to prevent integrated products and services from accessing certain types of information connected with your profile.

• Please refer to your device, browser, or platform provider's user guides for additional information about implementing any available platform-specific opt-outs.

11.10 Please note that under many countries' laws, you have the right to lodge a complaint with the supervisory authority in the place in which you live or work. If you live in Brazil, you have the right to lodge a complaint with the Brazilian Data Protection Authority (ANPD).

13. Regional Supplemental Disclosures

13.1 Supplemental Disclosures for Residents of Brazil

13.1.1 Legal Bases. Depending on the specific purpose of the processing, we may rely on different grounds than those listed under section 6.2, where permitted by and in accordance with the Brazilian General Data Protection Law (LGPD). For example, we may rely on the "exercise of legal rights" basis to process personal data associated with customer complaints and to enforce our Terms of Service and similar terms and agreements.

13.1.2 User Rights. In addition to the rights contemplated in Section 11.3, You may have the following rights in relation to your Personal Data:

• The right to request the anonymization, blocking, or deletion of unnecessary, excessive, or unlawfully processed Personal Data;

• The right to request the transfer of your Personal Data to another product or service provider when technically feasible and subject to express request and observance of our trade and industrial secrets;

• The right to revoke consent, to request the deletion of data processed based on consent, or to be informed of the possibility of refusing consent and the consequences of such refusal, where consent is required;

• The right to be informed about the public and private entities with whom we shared your Personal Data;

• The right to request a review of any decisions made solely through automated processing of your Personal Data that affect your interests, if applicable.

• The right to petition the Brazilian Data Protection Agency regarding the processing of your Personal Data.

Please keep in mind that these rights are not absolute and may not apply in certain circumstances. For example, in certain cases we may continue to process and retain data regardless of your request for deletion, objection, blocking or anonymisation, in order to comply with legal, contractual and regulatory obligations, safeguard and exercise rights, including in judicial, administrative and arbitration proceedings and in other cases provided for by law.

13.1.3 International Data Transfers. You acknowledge that InfiniteAI is a company based in Singapore. Any information we hold about you will be transferred to, used, processed, and stored in Singapore, the United States and/or other countries and territories, which may not have data privacy or data protection laws equivalent to those in your country or territory. For the proper operation of the Services, InfiniteAI needs to carry out international transfers of personal data. In the case of Brazil, we will rely on standard contractual clauses (SCCs) for our data transfers where required and in instances where they are not covered by an adequacy decision. These SCCs have been approved by the Brazilian Data Protection Authority (ANPD), which is the "competent supervisory authority" for these transfers, as governed by Brazilian Data Protection Laws.

11.5 Bergantung pada yurisdiksi Anda, Anda mungkin dapat memilih atau membatasi kuki yang digunakan saat Anda menggunakan Layanan kami atau mengontrol cara perangkat Anda mengizinkan penggunaan kuki, seperti melalui pengaturan peramban atau perangkat Anda. 13. Pengungkapan Tambahan Regional

13.1 Pengungkapan Tambahan untuk Penduduk Brasil

13.1.1 Dasar Hukum. Bergantung pada tujuan spesifik pemrosesan, kami dapat mengandalkan dasar hukum yang berbeda dari yang tercantum dalam pasal 6.2, sejauh diizinkan oleh dan sesuai dengan Undang-Undang Perlindungan Data Umum Brasil (LGPD). Misalnya, kami dapat mengandalkan dasar "pelaksanaan hak hukum" untuk memproses data pribadi yang terkait dengan keluhan pelanggan dan untuk menegakkan Ketentuan Layanan serta ketentuan dan perjanjian serupa kami.

• Hak untuk meminta peninjauan atas keputusan apa pun yang dibuat semata-mata melalui pemrosesan otomatis atas Data Pribadi Anda yang mempengaruhi kepentingan Anda, jika berlaku;

• Hak untuk mengajukan petisi kepada Badan Perlindungan Data Brasil terkait pemrosesan Data Pribadi Anda.

Harap diingat bahwa hak-hak ini tidak bersifat mutlak dan mungkin tidak berlaku dalam keadaan tertentu. Untuk pengoperasian Layanan yang sebagaimana mestinya, InfiniteAI perlu melakukan transfer data pribadi secara internasional. Dalam hal Brasil, kami akan mengandalkan klausul kontraktual standar (standard contractual clauses/SCC) untuk transfer data kami apabila diperlukan dan dalam hal-hal yang tidak tercakup oleh keputusan kecukupan (adequacy decision). SCC ini telah disetujui oleh Otoritas Perlindungan Data Brasil (ANPD), yang merupakan "otoritas pengawas yang berwenang" untuk transfer tersebut, sebagaimana diatur oleh Undang-Undang Perlindungan Data Brasil.

1.1 Migooをご利用いただきありがとうございます。本プライバシーポリシーは、Migoo（当社の関連会社と併せて、以下「Migoo」又は「当社」といいます。）が、本プライバシーポリシーにリンクしているウェブサイト、アプリケーション及びサービス（以下「サービス等」といいます。）に関連して、個人情報（以下に定義します。）をどのように収集し、利用し、保持し、開示し、及び処理するかを説明するものです。

1.2 「個人情報」とは、特定の個人又は世帯を識別し、これに関連し、これを叙述し、これと合理的に関連付けることができ、又は、利用可能な他の情報と組み合わせることにより、直接的又は間接的に、特定の個人又は世帯と合理的に結びつけることのできる情報をいいます。

1.3 当社は、特定の法域の居住者に関する個人情報の処理に関連して、異なる若しくは追加の開示を行うことを選択する場合もあり、又は異なる若しくは追加の開示を行うことを法律により要求される場合もあります。本プライバシーポリシーにおいて使用される用語は、別途定義される場合を除き、利用規約において定められた意味を有します。

1.4 当社は、本プライバシーポリシーを随時修正することがあり、その場合、当社は、本プライバシーポリシーの最終更新日を更新し、新しいプライバシーポリシーを掲示し、又は適用ある法律により要求されるその他の通知を行います。当社は、お客様が、当社の最新のプライバシー慣行を把握しておくために、定期的に本プライバシーポリシーを確認することを推奨します。

2. 当社によるお客様に関する情報の収集方法

2.1 当社は、お客様に関する特定のカテゴリーの情報を、様々な情報源から収集する場合があります。例えば、当社は、お客様が当社とのやり取りを行う際、又はサービス等を利用し、若しくはサービス等にアクセスする際に、お客様に関する情報を収集します。当社が収集する個人情報のカテゴリーは、お客様がどのように当社及び当社のサービス等とのやり取りを行うかに応じて異なります。

2.2 例えば、お客様は、以下の場合に、当社に対してお客様の個人情報又はその他の情報を提供する場合があります。

• サービス等を訪問し、サービス等を利用し、又はサービス等とのやり取りを行う場合

• サービス等に登録し、及び／若しくはサービス等を利用し、又は当社とのアカウント（以下「本アカウント」といいます。）を開設する場合

• サービス等に対して入力を提供する場合（お客様がアップロードし、又は送信するプロンプト、チャット及びその他のコンテンツを通じて提供する場合を含みます。）

• 電子メール、調査、フォームを経由して、又は当社のウェブページ、アプリ若しくはソーシャルメディアサイトを通じる等の方法によって、当社と連絡を取る場合

• お客様が、ご自身の本アカウントを第三者のアカウント、アプリケーション、プラットフォーム又はサービス（サービス等と連携するものを含み、以下「連携サービス」といいます。）とリンクし、又は接続する場合

• お客様が、連携サービスから又は連携サービスを通じて、個人情報を取得することを承認する許可（お客様の電子メール、カレンダー又はその他の情報へのアクセスを含みます。）を当社に付与する場合

• お客様が、お客様のデバイス上で、当社と情報を共有する許可（お客様のデバイスの連絡先、写真、カレンダー、位置情報、マイク、カメラその他の情報へのアクセスを含みます。）を当社に付与する場合

2.3 当社は、その他の情報源及び第三者から自動的に個人情報を収集する場合もあります。例えば、当社は、その他の第三者（分析プロバイダーを含みます。）又はお客様にサービス等へのアクセスを提供するために当社が提携する業務提携先及びその他の企業から、お客様に関する情報を取得する場合（お客様が当社に提供する情報に基づく場合を含みます。）があります。

2.4 お客様が提供する一切の情報（連携サービスを通じて提供されるものを含みます。）又は当社が第三者の情報源から受領する一切の情報は、本プライバシーポリシーに従って取り扱われます。当社は、お客様又は一切の第三者によって当社に提供された情報の正確性について責任を負わず、またいかなる第三者のポリシー又は慣行について責任を負いません。

3. お客様が当社に提供する情報

3.1 サービス等の一部の機能は、お客様に関する情報を求め、又は要求する場合があります。お客様は、かかる情報を提供しないことを選択することができますが、そのようにすることにより、お客様はこれらの機能を利用し、又はこれらの機能にアクセスすることができない場合があります。お客様が直接提出する情報には、以下が含まれます。

• 識別子及びその他の本アカウント情報　当社は、氏名、電話番号、電子メールアドレス、住所及びユーザーID等の識別子、並びにお客様のコミュニケーションに関する設定等のお客様のアカウントに関連するその他の情報を収集する場合があります。当社は、かかる情報を、お客様との間における当社の契約を履行するため、サービス等をお客様に提供するため、お客様の本アカウントを管理するため、お客様からの要請又は取引を完了するため、お客様と連絡を取るため、及び（お客様の嗜好に従って）お客様にマーケティングコミュニケーションを発信するためといった目的で利用します。お客様が他者をサービス等の利用に招待する場合、当社は、当該招待を送るために、かかる者の電子メールアドレスをお客様から収集します。

• ユーザーコンテンツ　お客様は、Migooに対して情報、指示及びその他の資料を入力し、アップロードし、アクセス可能な状態にし、及び送信する（以下「インプット等」といいます。）ことができます。これは、お客様が直接又はお客様がサービス等に組み込むことを選択した第三者のアプリケーション若しくは連携サービスを通じてのいずれかによって当社に提供し、又はアクセス可能な状態にした、あらゆるファイル、文書、音声、ビデオ、画像、データ、カレンダー情報、連絡先情報、メッセージ及びその他の通信を含みます。お客様からのインプット等に基づき、Migooは、様々なAIツール及び機能（第三者の提供者及びアプリケーションを含みます。）を利用して、テキスト、画像、ビデオ及びその他のレスポンス（以下「アウトプット等」といいます。）を生成し、又はお客様に代わり行為（以下「アクション」といいます。）を実施します。当社は、かかる情報を、お客様にサービス等を提供するため、お客様及びお客様の嗜好を把握するため、並びに当社がお客様に提供することができるインプット等、アウトプット等及びアクションを改善し、かつ、パーソナライズするために利用します。お客様が連携サービスを通じて当社に対してアクセス可能な状態にする情報は、お客様へのサービス等の提供において使用されるインプット等に影響を与え、当該インプット等を修正する場合があり、その結果として、当該情報がアウトプット等において再現され、又は提供されるアクションに反映される場合もあります。

• フィードバック及びサポート情報　当社は、お客様からのフィードバックを歓迎します。当社は、お客様のフィードバックに含まれる情報（フォーム、チャット、電子メール、ソーシャルメディア又は顧客が利用可能なその他の連絡手段を通じて送信されたメッセージの内容を含みます。）を収集する場合があります。当社は、主として、お客様からのお問い合わせを調査し、これに対応するため、お客様と連絡を取るため、及びサービス等を改善するためにかかる情報を利用します。

4. 自動で収集される情報

4.1 当社及び特定の第三者は、お客様がどのようにサービス等にアクセスし、サービス等を利用し、及びサービス等とやり取りを行うかに関する情報（以下を含みます。）を自動的に収集する場合があります。

• インターネット又はその他の電子的活動情報　これには、お客様のデバイスの種類、製造業者及びモデル、オペレーティングシステム、IPアドレス、ブラウザの種類、インターネットサービスプロバイダー、並びにお客様、お客様のデバイス又はお客様のネットワークに関連付けられた一意識別子（例えば、該当する場合は、永続的なデバイス識別子又は広告IDを含みます。）が含まれる場合があります。これは、お客様によるサービス等の利用及びサービス等とのやり取りに関する情報（クリック、スクロール及びキーストロークのデータ、タイムスタンプ、インプレッション並びにログデータを含む、サービス等にアクセスするためにお客様が利用するブラウザ又はアプリケーションに関する情報及びサービス等においてお客様が行う行為に関する情報を含みます。）も含む場合があります。

• ログ及びトラブルシューティング情報　当社は、お客様がサービス等を利用する際のサービス等の動作状況に関する情報を収集する場合があります。例えば、お客様のデバイスがエラーに見舞われた場合、当社は、当該エラー、当該エラーが発生した時刻、使用されている機能、アプリケーションの状態及び当該エラーが発生した時点において提供された通信又はコンテンツに関する情報を収集する場合があります。

• お客様の位置に関する情報　これには、お客様の正確な位置又は当社若しくは当社の第三者サービスプロバイダーが、お客様のIPアドレスから推定することができるおおよその位置が含まれる可能性があります。お客様が地図データ又は位置データを当社に対してアクセス可能な状態にする場合、当社は、お客様の位置及び位置履歴に関するその他の情報を収集する場合があります。

4.2 かかる情報は、当社自身及び当社の第三者パートナーの自動データ収集技術の利用を通じて収集される場合があります（個人のコンピュータ又はデバイスに保存され得るクッキー、ピクセル、スクリプト及びその他の小さなデータファイル（以下「クッキー」と総称します。）の利用を通じた収集を含みます。）。当社が自動的に収集するお客様に関する情報は、当社が直接お客様から収集する、又はその他の情報源から受領するその他の個人情報と組み合わされる場合があります。お客様が利用可能でありうるクッキーに関連する選択肢についての詳細は、以下の「お客様の権利及び選択肢」の項をご参照ください。

4.3 これらのツールを通じて収集された情報により、当社は、お客様を認識し、お客様に合わせて機能及びコンテンツを調整し、並びにお客様のユーザー体験を向上させることが可能となります。例えば、当社は、かかる情報を、お客様のユーザー体験を強化し、パーソナライズするため、サービス等を監視し、改善するため、ライブチャット及び自動化されたチャット等のコミュニケーション機能を提供するため、並びに当社の製品、サービス、オファー、広告、コミュニケーション及びカスタマーサービスの有効性を改善するために利用する場合があります。また、当社は、かかる情報を、お客様がサイトを閲覧している間又はお客様が次回サイトを訪問する際に再入力する必要がないように情報を記憶するため、（お客様の同意に基づき）ターゲティングされたコンテンツ及び広告を含む、カスタマイズ及びパーソナライズされたコンテンツ及び情報を提供するため、複数のデバイス又はセッションをまたいでお客様を識別するため、サービス等を提供し、及びサービス等の有効性を監視するため、当社のウェブサイトにおける訪問者総数、通信量、利用量及び人口統計上のパターン等の集計指標を監視するため、技術上の問題を診断し、又は解決するため、並びに、その他サービス等を計画し、及びサービス等を強化するために利用する場合があります。

4.4 第三者のツール及び機能を通じて自動データ収集技術をブロックすることで、一部の機能及びサービス内容が適切に機能しない、又は全く機能しない場合があるため、サービス等の利用におけるお客様の体験に悪影響が及ぶ場合があることにご注意ください。お客様が利用する第三者のツール又は機能に応じて、お客様は、全ての自動データ収集技術をブロックすることができない場合があり、又は複数のサービス、デバイス若しくはブラウザにおいてお客様の嗜好を更新する必要がある場合があります。当社は、これらの第三者のツール及び機能について一切管理しておらず、これらの第三者のツール及び機能が意図されたとおりに機能しない場合、責任を負いません。

5. その他の情報源から収集した情報

5.1 当社は、お客様が当社と共有することを選択したお客様に関する情報を第三者から取得する場合があり、また、場合によっては、第三者から直接取得することがあります。連携サービスを通じてお客様が当社に提供する情報に加えて、これには以下が含まれます。

• シングルサインオン情報　当社は、お客様に対し、お客様が維持する特定の第三者アカウント（Apple又はGoogle等）を通じてサービス等にログインする機能を提供します。お客様がサービス等にアクセスするためにこれらの機能を利用する場合、当社は、関連する第三者サービスにかかるお客様のログイン認証情報を受領しません。代わりに、当社は、当社のシステムにおいてお客様を識別し、お客様がシングルサインオンプロトコルを通じて正常に認証されたことを確認するためのトークンを受領します。この情報により、当社は、お客様に対してサービス等へのアクセスをより容易に提供することが可能となります。

• ソーシャルメディア情報　お客様がソーシャルメディアプラットフォームを通じてサービス等とのやり取りを行う場合（お客様が当社をフォローする場合又はお客様のソーシャルメディアアカウントをサービス等と接続する場合等）、当社は、お客様がかかるソーシャルメディアプラットフォームに対して第三者と共有することを許可する情報の一部を受領する場合があります。当社が受領するデータは、ソーシャルメディアプラットフォームにおけるお客様のプライバシー設定に依存し、お客様のプロフィール情報、プロフィール写真、ユーザー名及びお客様がソーシャルネットワークに対して第三者と共有することを許可するその他の情報を含む場合があります。お客様は、情報を共有し、又は第三者のウェブサイト及びソーシャルメディアプラットフォームをサービス等にリンクする前に、第三者のウェブサイト及びソーシャルメディアプラットフォームにおけるお客様のプライバシー設定を確認し、必要に応じてこれを調整して下さい。当社は、かかる情報を主として、サービス等の機能及び機能性を運用し、維持し、及びお客様に提供するため、並びにお客様と直接連絡を取るため（お客様が関心を持つ可能性のある機能に関するメッセージをお客様に送信するため等）に利用します。

• 提携先情報　これには、当社が提携するその他の事業者及び企業から当社が受領する情報が含まれます（当社は、かかる情報をサービス等へのアクセスをお客様に提供する当社の正当な利益に基づき利用する場合があります。）。

6. 当社による個人情報の利用目的

6.1 上記に既に記載された目的に加えて、当社は、当社が収集する個人情報を以下の目的で利用する場合があります。

• 当社の契約上の義務を履行するため、及びお客様にサービス等を提供するため等、情報が提供された理由を達成し、又はかかる理由に対処するため。

• 当社のユーザーのために本アカウントを作成し、維持するため（お客様の本人確認及びサービス等を利用する権限を確認することを含みます。）。

• お客様のインプット等を処理し、アウトプット等を提供し、又はお客様に代わってアクションを行うため。

• お客様のユーザープロファイルを作成し、お客様に関する情報（お客様の関心及び嗜好等）を推測するため。

• お客様と連絡を取るため（電子メール、テキストメッセージ、チャット、ソーシャルメディア及び／又は電話による連絡を含みます。）。

• サービス等に関連するフィードバック又は苦情を求め、及び当該フィードバック又は苦情に対応するため。

• サービス等を管理し、改善し、及びパーソナライズするため（より良いサービス等を提供するためにお客様の関心及び嗜好についての理解を深めること、お客様がサービス等を再度利用する際にお客様を認識し、お客様の情報を記憶すること、並びに当社自身及び他者の技術を用いてユーザーコンテンツ、メッセージ、やり取り及び関連するメタデータをスキャンし、分析し、及び確認することによるものを含みます。）。

• 適用ある法律に従い、当社又は当社の業務提携先のモデルを訓練し、改善するため。

• サービス等に関する調査を行い、並びにサービス等及びお客様によるサービス等の利用・やり取りの状況を把握し、分析するため。

• お客様を識別するために合理的に用いることができない集計された情報又は非識別化された情報を作成するため（当社は、かかる情報をサービス等の利用方法を分析するため、サービス等を改善し、及びサービス等に機能を追加するため、並びに調査を行うため等、本項に記載された目的のために利用する場合があります。）。

• 違法な、欺瞞的若しくは悪意のある一切の行為、詐欺、セキュリティ侵害、若しくはサービス等若しくはシステムのその他の不正使用を検知し、防止し、調査し、又はこれらについて通知を行うため、並びに当社、当社のユーザー、当社のシステム及びサービス等並びにその他の第三者のセキュリティ並びに安全を保護するため（一切のインプット等、アウトプット等又はアクションを監視することによるものを含みます。）。

• 当社の権利又は適用される契約及び合意（当社の利用規約を含みます。）を防御し、保護し、又は行使するため、並びに紛争を解決するため、当社の義務を履行し、当社の権利を行使するため、並びに当社の事業上の利益並びに第三者の利益及び権利を保護するため。

• 契約上の義務及び要件並びに法的義務及び法的要件を遵守するため、並びに当社、当社のユーザー及び第三者の権利、プライバシー、安全又は財産を保護するため。

• お客様が別途同意したその他の目的、又は当社が正当な根拠を有するその他の目的を達成するため。

6.2 お客様がお住まいの法域における法律が、特定の目的について、正当な利益の法的根拠又は本プライバシーポリシーに定めるその他の法的根拠を認めていない範囲において、お客様は、サービス等を利用することで当該目的のためのお客様の個人情報の収集、保存及び処理に同意します。

7. お客様の情報の開示

7.1 当社は、本プライバシーポリシーに従い、お客様の情報をその他の第三者（以下を含みます。）に開示する場合があります。

• 承認された第三者ベンダー及びサービスプロバイダー　当社は、当社のサービス等の提供を支援するベンダー、委託先又はその他のサービスプロバイダーと、お客様の情報を共有する場合があります（システム管理、クラウドストレージ、生成AI及びコンテンツ作成、セキュリティ、顧客取引の円滑化及び関係管理、マーケティングコミュニケーション、ウェブ分析、決済ネットワーク並びに決済処理のためのものを含みます。）。また、お客様から提供された入力内容や情報は、OpenAI、Anthropic、Google、及びその他の選定されたプロバイダーなどのAIモデルやプロバイダーに転送される場合があります。これらのプロバイダーは、それぞれのプライバシーポリシーに基づきデータを処理します。適用ある法律に従い、承認された第三者ベンダーには、広告を提供するため、並びに広告関連サービス（レポーティング、アトリビューション、分析及び市場調査等）を提供するため当社が特定のサービスに関連して協働する可能性がある当社の広告提携先が含まれる場合があります。

• 連携サービスを含むその他の第三者　当社は、お客様が当社に対して要請し、又は指示する場合等に、お客様の情報をその他の第三者に開示する場合があります（連携サービス、ソーシャルメディアプラットフォーム又はその他の第三者においてお客様が保有するその他のアカウントとお客様の本アカウントをリンクし、又は統合することによるものを含みます。）。これには、お客様が連携サービスを通じて若しくは連携サービスを利用して、お客様に代わってアクションを行うようにサービス等に指示する場合（お客様に代わって電子メールを送信し、又はカレンダーの記載事項を編集する等）、又はログイン連携を利用してアウトプット等その他の情報を、Migooのその他のユーザーを含む他の個人に対して表示可能な状態にするようサービス等に指示する場合が含まれます。当社は、契約の履行に必要な場合、サービス等へのアクセス及び第三者との連携をお客様に提供する当社の正当な利益に基づき、又はお客様の同意に基づき、これを行います。

• 専門アドバイザー　当社は、必要に応じて、お客様の個人情報を監査人、法律事務所又は会計事務所等の専門アドバイザーと共有します。

• 事業取引又は組織再編に関連する場合　当社又は当社の関連会社は、合併、買収、合弁事業、資金調達又は会社資産の売却等の事業取引又は組織再編に参加し、又はこれらに関与する場合があります。当社は、当該事業取引又は組織再編の交渉中、これらに関連して、又は当該事業取引又は組織再編における資産として、個人情報を第三者に開示し、移転し、又は譲渡する場合があります。また、万が一当社が破産し、財産管理の対象となり、又は支払不能となる場合、お客様の個人情報は、かかる手続又は当社の資産の処分に関連して、第三者に開示され、移転され、又は譲渡される場合があります。

• お客様の同意に基づく場合　当社は、お客様の同意に従い、又はお客様の指示に基づき、その他の一切の目的のために情報を共有する場合があります。

当社のウェブサイト及びその他のサービスには、第三者のウェブサイト、プラグイン、アプリケーション又はその他のサービスへのリンクが含まれる場合があり、又はこれらはお客様をリダイレクトする場合があります。第三者のウェブサイト及びその他のサービスは、当社のウェブサイト及びサービスに言及し、又は当社のウェブサイト及びサービスにリンクする場合もあります。本プライバシーポリシーは、これらの第三者のウェブサイト、プラグイン、アプリケーション又はその他のサービスにおけるいかなる個人情報に関する慣行にも適用されません。これらの第三者の個人情報に関する慣行について知るため、各々のプライバシーポリシーを閲覧してください。

8. データ移転

8.1 お客様が当社のウェブサイト又はサービス等にアクセスする場合、お客様は、お客様の個人情報が、お客様がお住まいの法域外であって、当社のサーバー、関連会社又は第三者サービスプロバイダーが所在する場所に移転され、又は保存される場合があることを理解し、かつ、同意します。これは、お客様の個人情報の当社に対する直接提供である場合、又は当社若しくは第三者が行う移転である場合があります。当社は、データが移転される移転先がいずれも、適用ある法律及び本プライバシーポリシーに定める基準に従ってデータを処理し、かつ、保存することを確保するための措置を講じており、また、当社は、法的に有効な移転メカニズムに従ってのみデータを移転します。

9. データセキュリティ及びデータ保持

9.1 当社は、お客様の個人情報を保護するために設計された、商業的に合理的な技術的、管理的、物理的及び組織的保護措置を実施しています。さらに、当社は、当社が個人情報を共有する第三者が同等の水準の保護を提供することを確保するために設計された措置を講じています。但し、これらの措置にもかかわらず、いかなるセキュリティ対策も侵入不可能なものではなく、当社は、お客様の個人情報のセキュリティを完全に確保し、又は保証することはできません。お客様は、ご自身がどの情報をサービス等に提供するか、及びどの送信経路を当該情報を送信するために使用するかを決定する過程において、特別の注意を払う必要があります。

9.3 当社は、お客様の個人情報を、当該個人情報が収集された目的を達成するために（本プライバシーポリシーに記載されている法律上、会計上又は報告上の一切の要件を充足するための場合を含みます。）合理的に必要な期間保持します。保持期間は、処理の状況及び当社の法的義務等の一定の基準（当社がお客様にサービス等を引き続き提供するため、紛争を解決するため、当社の契約上の合意を執行するため、損害を防止するため、安全性、セキュリティ及び完全性を促進するため、又は当社自身（当社の権利、財産又は製品を含みます。）を保護するためにかかる情報を必要とするか否かを含みます。）に応じて異なる場合があります。

10. 子供

10.1 サービス等は、18歳未満の子供に向けられたものではなく、又は18歳未満の子供を対象としたものではありません。当社は、いかなる18歳未満の者からも故意に個人情報を収集せず、また、サービス等のいかなる部分も18歳未満の者に向けられていません。親又は後見人として、お客様が監護する当該子供がサービス等に個人情報を提出するのを許可しないようお願いいたします。詳細な情報については、当社の利用規約をご参照ください。

10.2 お客様が監護する18歳未満の子供が当社に対して個人情報を開示したと判断する場合は、当社のデータ保護責任者（dpo@migoo.ai）にご連絡ください。当社は、いかなる通知についても調査を行い、また、適切な場合には、適用ある法律に要求されるとおり当該子供によってのみ使用された本アカウントを削除し、及び／又は提出された一切の個人情報を削除します。

11. お客様の権利及び選択肢

11.1 当社は、お客様のプライバシーを重視しており、お客様の個人情報の保護及び適用ある全てのプライバシーに関する法律の遵守を最優先事項として取り組んでいます。

11.2 お客様がお住まいの法域又は居住地の法律によっては、以下に記載されるとおり、お客様の個人情報に関して一定の権利が認められる場合があります。但し、かかる権利には制限があること、また、当社に法的根拠がある場合には、一定のご要望をお断りすることがあることにご留意ください。

11.3 お客様がお住まいの法域又は居住地の法律に基づき、お客様は、以下の権利を有する場合があります。

• 当社によるお客様の個人情報の処理に関する一定の情報を知る権利（多くの場合、ポータブルなフォーマットでお客様の個人情報にアクセスする権利を含みます。）

• お客様の個人情報の削除を請求する権利

• お客様の個人情報を更新し、修正する権利

• 個人情報の一定の処理又は一定のカテゴリーの個人情報に関して、ご自身の同意を撤回する権利

• お客様のプライバシー権の行使に関して報復を受けない権利

11.4 当社は、クロスコンテキスト行動広告の目的で個人情報を「販売」したり、「共有」したりすることはなく、「ターゲティング広告」の目的で個人情報を処理することはありません（これらの用語は、プライバシーに関する州法に定義されます。）。

11.5 お客様がお住まいの法域によっては、お客様は、当社のサービス等を利用するにあたり、使用されるクッキーを選択又は制限すること、又はお客様のブラウザ又はデバイスの設定などを通じて、お客様のデバイスにおけるクッキーの使用方法を管理することができます。クッキーをブロック又は削除した場合、一部のサービス等（特定の機能及び一般的な機能性を含みます。）が正常に動作しなくなる場合があることにご注意ください。例えば、クッキーをブロック又は削除すると、当社は、セッション又はデバイスをまたいでお客様を認識できなくなるか、お客様の設定の一部を記憶できなくなる場合があります。また、Google Analyticsによるトラッキングをこちらから無効にすることもできます。一部のモバイルブラウザ及びウェブブラウザは、「トラッキング拒否(Do Not Track)」信号を送信します。ウェブブラウザにおけるかかる機能の組み込み方法及び有効化方法の違いによって、ユーザーが当該信号の送信を意図しているか否か、又は当該信号を認識しているか否かについてさえ、必ずしも明確ではありません。当社は現在、これらの信号に対応する措置を講じていません。

11.6 当社は、お客様に関する情報のうちセンシティブとみなされる可能性のある情報を処理する場合がありますが、お客様が当社に要請した製品又はサービスを提供するため、又はお客様の同意に従う場合などに限り、適用ある法律に従って当該情報を処理します。サービス等は、適用ある法律に基づき「ハイリスク」とみなされる可能性のある目的、又はユーザーその他の者に関する信用、教育、雇用、住宅、保険、法律、医療、税務その他の重要な決定を行う目的のために意図されたものではありません。また、当社は、第三者のダイレクト・マーケティングの目的で、当該第三者とお客様の情報を共有することはなく、適用ある法律に定義される法的効果又はこれに類する重大な影響をもたらすプロファイリングを行うこともありません。

11.7 お客様は、ご自身の権利を行使する場合、ご自身又は授権された代理人を通じて、当社のデータ保護責任者に対して、下記の連絡先宛に連絡することができます。当社は、適用ある法律に従ってかかる請求を処理しますが、全ての状況において、お客様の個人情報を修正又は消去できるとは限らないことにご注意ください。お客様のプライバシーを保護するために、当社は、お客様からの請求に対応する前に、お客様の本人確認を行うために措置を講じる必要がある場合があります。当社は、お客様がプライバシー権を行使したことを理由として、お客様を差別することはありません。

11.8 お客様がお住まいの地域によって、お客様は、ご自身の権利を行使する請求に関して当社が行った決定に対して、異議を申し立てる権利を有する場合があります。お客様は、当社のデータ保護責任者に対して連絡することで、かかる申立を行うことができます。お客様は、当社がデータ保護に関する法律を侵害したとお考えの場合、データ保護監督機関に対して苦情を申し立てることができます。当該申立は、通常、お客様がお住まいの法域又は当社がデータ保護に関する法律を侵害したと考える法域において行うことができます。

11.9 上記の権利に加えて、当社は、お客様の個人情報及びその使用方法について、いくつかの管理手段を提供します。お客様は、ご自身のアカウントにおいて、いつでも設定を変更することができます。以下の管理手段が含まれます。

• お客様は、本アカウントを削除すること、又はお客様のデバイスから当社のアプリケーションを削除することができます。

• お客様は、当社から受信するマーケティングコミュニケーションにおいて提供される選択肢を利用することにより、当該コミュニケーションの配信を停止することができます。

• 例えば、お客様は、ご自身のGoogle Accountのセキュリティ設定（https://myaccount.google.com/security）を通じて、サービス等に付与された許可をいつでも確認し、取り消すことができます。許可を取り消した場合、サービス等の利用可能性又は機能性が制限される、又は無効となる場合があります。

• 同様に、多くのモバイルデバイスでは、サービス等がお客様のデバイス内の特定の情報（お客様の連絡先リスト、写真又は位置データなど）にアクセスすることを防ぐために、お客様の許可を変更することができます。

• 多くのソーシャルメディア・プラットフォームでは、統合された製品及びサービスが、お客様のプロファイルに関連付けられた特定のカテゴリーの情報にアクセスすることを防ぐために、お客様のプラットフォーム上の許可を変更することができます。

13. 地域別の補足開示

13.1 ブラジル居住者向けの補足開示

13.1.1 法的根拠　処理の具体的な目的に応じて、当社は、ブラジル一般データ保護法（LGPD）により認められ、かつ同法に従う場合には、第6.2条に記載された根拠とは異なる根拠に依拠する場合があります。例えば、当社は、顧客からの苦情に関連する個人情報を処理し、また、当社の利用規約その他類似の条件及び合意を執行するために、「法的権利の行使」という根拠に依拠する場合があります。

13.1.2 ユーザーの権利　第11.3条に定める権利に加えて、お客様は、ご自身の個人情報に関して、以下の権利を有する場合があります。

• 不要、過剰又は違法に処理された個人情報の匿名化、ブロック又は削除を請求する権利

• 技術的に可能であり、かつ明示的な請求があり、当社の営業秘密及び産業上の秘密の保護を条件として、ご自身の個人情報を他の商品又はサービスプロバイダーに移転することを請求する権利

• Conteúdo do Usuário. Você pode inserir, carregar, tornar acessível e enviar informações, instruções e outros materiais no Migoo (“Input”). Isso inclui quaisquer arquivos, documentos, áudios, vídeos, imagens, dados, informações de agenda, informações de contato, mensagens e outras comunicações que você forneça ou torne acessíveis para nós, seja diretamente ou por meio de quaisquer aplicações de terceiros ou Serviços Conectados que você escolha integrar aos Serviços. Com base no seu Input, o Migoo utilizará diversas ferramentas e funcionalidades de IA, incluindo fornecedores e aplicações de terceiros, para gerar textos, imagens, vídeos e outras respostas (“Output”) ou para executar ações em seu nome (“Ações”). Utilizamos essas informações para fornecer os Serviços a você, para conhecê-lo melhor e entender suas preferências, e para melhorar e personalizar o Input, Output e Ações que podemos oferecer para você. As informações que você tornar acessíveis por meio dos Serviços Conectados podem influenciar e modificar o Input utilizado na prestação dos Serviços e, consequentemente, também podem ser reproduzidas no Output ou refletidas nas Ações fornecidas.

• Feedback e Informações de Suporte. Apreciamos seu feedback. Podemos coletar as informações contidas em seu feedback, incluindo o conteúdo de mensagens enviadas por meio de formulários, chat, e-mail, redes sociais ou outros canais disponíveis aos usuários. Dependendo da ferramenta ou funcionalidade de terceiros que você utilize, poderá não ser possível bloquear todas as tecnologias de coleta automática de dados, ou poderá ser necessário atualizar suas preferências em múltiplos serviços, dispositivos ou navegadores. Não temos qualquer controle sobre essas ferramentas e funcionalidades de terceiros e não nos responsabilizamos caso elas não funcionem conforme o esperado.

5. Informações Coletadas de Outras Fontes

5.1 Podemos obter informações sobre você que você opte por compartilhar conosco a partir de terceiros e, em alguns casos, diretamente de terceiros. Além das informações que você nos fornece por meio dos Serviços Conectados, isso inclui:

• Informações de login único (single sign-on). Oferecemos a você a possibilidade de fazer login nos Serviços por meio de determinadas contas de terceiros que você mantém, como Apple ou Google. Quando você utiliza essas funcionalidades para acessar os Serviços, não recebemos suas credenciais de login no respectivo serviço de terceiros. • criar seu perfil de usuário e inferir informações sobre você, como seus interesses e preferências;

• nos comunicarmos com você, inclusive por e-mail, mensagem de texto, chat, redes sociais e/ou chamadas telefônicas;

• solicitar e responder a feedbacks ou reclamações relacionadas aos Serviços;

• administrar, melhorar e personalizar os Serviços, inclusive por meio do desenvolvimento de uma compreensão sobre seus interesses e preferências para fornecer Serviços melhores, reconhecendo você e lembrando suas informações quando você retornar aos Serviços, bem como por meio da varredura, análise e revisão de conteúdos de usuários, mensagens, interações e metadados associados, utilizando tecnologias próprias e de terceiros;

• treinar e aprimorar os nossos modelos ou os modelos de nossos parceiros comerciais, conforme permitido pela legislação aplicável;

• realizar pesquisas e identificar e analisar os Serviços e a forma como você utiliza e interage com os Serviços;

• criar informações agregadas ou desidentificadas que não possam razoavelmente ser utilizadas para identificá-lo, as quais podemos usar para as finalidades descritas nesta Política, como analisar a forma como os Serviços estão sendo utilizados, aprimorá-los e adicionar novas funcionalidades, bem como para conduzir pesquisas;

• detectar, prevenir, investigar ou notificar sobre quaisquer atividades ilegais, enganosas ou maliciosas, fraudes, violações de segurança ou outros usos indevidos dos Serviços ou dos sistemas, bem como proteger a nossa segurança e integridade, de nossos usuários, de nossos sistemas e Serviços e de terceiros, inclusive por meio do monitoramento de quaisquer Input, Output ou Ações;

• defender, proteger ou exercer nossos direitos ou contratos e acordos aplicáveis (incluindo nossos Termos de Serviço), bem como resolver disputas, cumprir nossas obrigações e exercer nossos direitos, além de proteger nossos interesses comerciais e os interesses e direitos de terceiros;

7.1 Podemos divulgar suas informações a outras partes, sujeitas a esta Política de Privacidade, incluindo as seguintes:

Sujeito à legislação aplicável, tais fornecedores terceiros autorizados também podem incluir nossos parceiros de publicidade, com os quais podemos trabalhar para fornecer publicidade, bem como serviços relacionados à publicidade, como relatórios, atribuição, análises e pesquisas de mercado.

• Empresas afiliadas. Podemos divulgar suas informações às nossas subsidiárias, controladoras, afiliadas e empresas relacionadas.

• Outros terceiros, incluindo os Serviços Conectados. Podemos divulgar suas informações a outros terceiros, como quando você solicita ou nos instrui a fazê-lo, inclusive ao vincular ou integrar sua Conta a outras contas mantidas por você nos Serviços Conectados, plataformas de redes sociais ou outros terceiros. Isso inclui situações em que você instrui os Serviços a realizar Ações em seu nome por meio ou com o uso dos Serviços Conectados, como, por exemplo, enviar um e-mail ou editar uma entrada de calendário em seu nome, ou ao utilizar integrações de login para tornar o Output ou outras informações visíveis a outros indivíduos, incluindo outros usuários do Migoo. Nós ou nossas empresas afiliadas podemos participar ou estar envolvidos em uma operação societária ou reorganização, como uma fusão, aquisição, joint venture, financiamento ou venda de ativos da empresa. • você pode cancelar o recebimento de comunicações de marketing enviadas por nós, utilizando as opções disponibilizadas nessas comunicações;

• você pode remover ou limitar permissões, acessos e contas de terceiros vinculadas às quais você nos concedeu acesso, seja por meio dos Serviços ou, em alguns casos, diretamente no site ou aplicação do terceiro.

• por exemplo, você pode revisar e revogar permissões concedidas aos Serviços a qualquer momento por meio das configurações de segurança da sua Conta Google aqui. A revogação de permissões poderá limitar ou desativar a disponibilidade ou a funcionalidade dos Serviços.

• da mesma forma, muitos dispositivos móveis permitem que você altere permissões para impedir que os Serviços acessem determinadas informações do seu dispositivo (como lista de contatos, fotos ou dados de geolocalização);

• diversas plataformas de redes sociais permitem que você altere permissões para impedir que produtos e serviços integrados acessem determinados tipos de informações associadas ao seu perfil;

• consulte os guias de usuário de seu dispositivo, navegador ou plataforma para obter mais informações sobre como implementar quaisquer mecanismos de exclusão disponíveis.

13. Informações Suplementares Regionais

13.1 Informações Suplementares para Residentes do Brasil

13.1.1 Bases legais. Dependendo da finalidade específica do tratamento, poderemos nos basear em fundamentos legais distintos daqueles previstos na Cláusula 6.2, quando permitido e em conformidade com a Lei Geral de Proteção de Dados Pessoais (LGPD). Por exemplo, poderemos nos basear na hipótese legal de “exercício regular de direitos” para tratar dados pessoais relacionados a reclamações de consumidores e para fazer cumprir nossos Termos de Serviços e termos e condições similares.

13.1.2 Direitos dos Titulares. Além dos direitos previstos na Cláusula 11.3, você poderá ter os seguintes direitos em relação aos seus Dados Pessoais:

• o direito de solicitar a anonimização, bloqueio ou eliminação de Dados Pessoais desnecessários, excessivos ou tratados em desconformidade com a legislação;

• o direito de solicitar a portabilidade dos seus Dados Pessoais a outro fornecedor de produto ou serviço, observados os segredos comercial e industrial e a viabilidade técnica;

• o direito de revogar o consentimento, de solicitar a eliminação dos dados tratados com base no consentimento, ou de ser informado sobre a possibilidade de não fornecer consentimento e sobre as consequências dessa recusa, quando o consentimento for necessário;

• o direito de obter informações sobre as entidades públicas e privadas com as quais compartilhamos seus Dados Pessoais;

• o direito de solicitar a revisão de decisões tomadas unicamente com base em tratamento automatizado de dados pessoais que afetem seus interesses, quando aplicável;

• o direito de peticionar à ANPD em relação ao tratamento de seus Dados Pessoais.

Observe que esses direitos não são absolutos e podem não se aplicar em determinadas circunstâncias. Quaisquer informações que mantivermos sobre você serão transferidas, utilizadas, tratadas e armazenadas em Singapura, nos Estados Unidos e/ou em outros países e territórios que podem não possuir leis de privacidade ou proteção de dados equivalentes às do seu país ou território. Para o adequado funcionamento dos Serviços, a InfiniteAI necessita realizar transferências internacionais de dados pessoais. No caso do Brasil, utilizaremos cláusulas contratuais padrão para as transferências de dados, quando exigido, e nos casos em que tais transferências não estejam abrangidas por decisão de adequação. Essas cláusulas contratuais padrão foram aprovadas pela ANPD, que é a autoridade supervisora competente para essas transferências, nos termos da legislação brasileira de proteção de dados.
